Agreement
These terms are an agreement between you and Human Motion Associates ("we", "us") for use of the Kynexis MRI app and website (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.
Educational use — not medical advice
Kynexis Movement Recognition Index is an educational movement assessment. It does not diagnose, treat, or predict any injury or medical condition, and it does not replace care from a licensed healthcare professional. Coaches and evaluators using the app are not providing medical care through it.
Exercises are performed at your own risk. Stop if you feel pain or are unsure whether a test or exercise is safe for you, and consult a healthcare professional. Users under 18 need permission from a parent or guardian.
Kynexis MRI is not a medical device. Scores, risk levels and exercise suggestions are for coaching and education only, and you are responsible for deciding whether a test or exercise is appropriate for an athlete.
Your account
- You must be at least 18 years old to create an account.
- Provide accurate information and keep your password secure.
- You are responsible for activity under your account.
Athlete information and consent
You may only enter information and record video of athletes you are authorized to assess. For athletes under 18, you must have permission from a parent or guardian before entering their information or recording video.
You own the information and videos you add. You give us permission to store and process them only to provide the Service to you.
Subscriptions and billing
- Subscriptions are purchased on our website and billed through Stripe. Current prices are shown at checkout.
- Subscriptions renew automatically each month or year until cancelled.
- You can cancel anytime from Settings → Manage Subscription. You keep access until the end of the period you have already paid for, and you will not be charged again.
- Deleting your account cancels your subscription immediately and ends your access.
- Payments are non-refundable, including for unused time, except where required by law. For billing questions, contact us at humanmotion@me.com.
- We will give you notice before any price change takes effect on your subscription.
Acceptable use
Do not misuse the Service — for example, do not access other users' data, interfere with the Service, copy or resell its content, or use it for anything unlawful.
Our content
The app, scoring method, exercise library and instructional videos belong to Human Motion Associates and are licensed to you for use with your subscription only.
Ending your use
You can stop using the Service and delete your account at any time. We may suspend or close accounts that break these terms.
Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, to the extent permitted by law. To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for any injury arising from exercises or decisions based on the Service. Our total liability is limited to the amount you paid us in the 12 months before the claim.
App Store terms
If you downloaded the app from Apple's App Store:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation.
- We, not Apple, are responsible for handling any claims relating to the app, including product liability, legal compliance and intellectual property claims.
- You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of the United States and of the state in which Human Motion Associates has its principal place of business, without regard to conflict-of-law rules.
Changes
If we make material changes, we will update the effective date above and notify you in the app or by email. Continuing to use the Service means you accept the updated terms.
